This Service Agreement and Release (“Agreement”) governs (A) recurring pool cleaning and maintenance memberships and (B) quoted one-time services and repairs provided by All Set Pool Services (“All Set,” “we,” “us,” “our”) to you (“Customer,” “you,” “your”). By checking the consent box at checkout — whether starting a membership at allsetpools.com or accepting a written quote through your secure quote link — you agree to the terms below, including the Release and Limitation of Liability in Sections 8–10.
Part A — Membership Terms
1. Plans and pricing
Membership pricing is set by the size of your pool. We measure it from satellite imagery and the depth you tell us, and the resulting estimate places your pool in one of our published size bands. Your band, your plan, and your monthly price are shown to you before you pay, and are stated again in your confirmation email.
The plans we offer, what each one includes, the size bands, and the monthly price of each plan in each band are published on allsetpools.com and are shown to you in full before you subscribe. Where a size range meets, the higher number belongs to the smaller band. A pool larger than our largest published band is quoted by hand and is not priced from the bands. The price you are shown at checkout, and which is restated on your confirmation, is the price you are charged.
What you are buying is the plan you were shown at checkout, on the terms shown with it. This Agreement deliberately does not list the plans, their contents, or their prices. Those change; this document does not change with them, and a stale list inside a contract is the one copy a customer can hold us to after we have corrected it everywhere else. Your confirmation email is the record of what you selected. Section 14 governs changes to your price after you subscribe.
Every plan includes a weekly service visit (skim, brush, vacuum, equipment check), photo visit reports, and weekly water-chemistry reports. Plans differ in how chemicals and filter cleans are handled: a plan either includes an item in your monthly price or bills it only as used, at a price disclosed to you before it is applied or performed. Which of those applies to your plan is stated on the plan you accept at checkout, and nothing outside it is charged without your approval. Where a plan carries a discount on repair work, that discount applies for as long as that membership is active.
If your first visit shows the pool is materially different from what we measured, we will tell you the correct band and price before your next bill. We will not move you up a band without telling you first.
2. Your first charge
The amount due today, the date of your next charge, and any introductory offer applied to your signup are shown to you at checkout and restated in your confirmation email. What that page says is what happens — we do not take a charge it did not disclose, and we do not disclose one we then do not take. Only one introductory offer applies to a subscription, and offers cannot be combined.
After that, billing recurs monthly at the full monthly rate for your plan and band, unless your confirmation email says otherwise.
3. Cancellation
There is no term commitment and no early-termination fee, but this Agreement remains in force while your membership is active. You cancel through your billing portal, and cancellation takes effect immediately when you confirm it — there is no scheduled or pending cancellation to change your mind about, and nothing cancels on your behalf.
What cancelling costs you is the remainder of the month you are already in, and nothing after it. The month you have already paid for is not refunded and is not prorated; your service continues through the end of that paid period, and you are not charged again. We will email you a confirmation stating the amount you last paid, the date you paid it, and the date your service runs through.
Billing recurs monthly on your signup date. Your card statement will show ALL SET POOL SERVICES.
4. Service guarantee
If a visit fails our published service standards (Exhibit A), tell us within 7 days and we will redo the visit or refund it — your choice. This guarantee is quality-only; it does not create liability beyond the visit price (see Section 9).
5. At-cost and quoted items
Some items are never marked up into your membership and are charged (with your approval) only when needed: filter media replacement, salt for salt pools, salt-cell replacement, equipment seals and gaskets, stabilizer/conditioner top-ups, calcium/scale treatments. Larger jobs (green-to-clean restoration, acid wash, drain & refill, storm cleanup, and similar) are always quoted in writing before any work.
Part B — Quoted Work (One-Time Services & Repairs)
6. Quotes, deposits, and balances
Quoted work is described in a written quote delivered by secure link. You choose which line items to accept. Depending on the payment plan on your quote, you pay either in full at acceptance or a deposit at acceptance with the balance charged to your card on file after the work is completed. Amounts shown at checkout are the amounts charged.
7. Scheduling and access
You are responsible for providing safe access on the scheduled date (gates unlocked, dogs secured, water and power available). If we cannot access or safely service the pool, we may reschedule; repeated failed access may be billed as a visit.
Part C — Release, Assumption of Risk, and Limitation of Liability
8. Conditions outside our control — release
Pools and pool equipment age, wear, and fail in ways that professional service can reveal but does not cause. To the fullest extent permitted by Nevada law, you release All Set from claims arising out of conditions outside our reasonable control, including without limitation:
- Pre-existing conditions: deterioration, damage, or failure of equipment, plumbing, seals, o-rings, valves, heaters, pumps, motors, salt cells, filters, tile, plaster, pebble, fiberglass, or vinyl surfaces that existed before our work or that manifests during ordinary, workmanlike service of already-worn components (e.g., a brittle fitting that breaks during a normal filter clean).
- Drain-related risks (drains, chlorine washes, acid washes): surface conditions revealed once water is removed (stains, delamination, cracks, liner wear); vinyl liner shrinkage or brittleness inherent to drained liners; and hydrostatic pressure damage (“pool pop”) — we follow standard practice including relief measures where applicable, but ground-water conditions are not controllable or fully detectable.
- Water and environment: source-water quality, weather events, wind and debris, monsoon storms, freeze events, power or utility interruptions, wildlife, and other acts of God.
- Third parties and interference: chemicals added by you or anyone other than All Set between visits, settings changed on equipment between visits, work performed by other contractors, and vandalism.
- Consequences of declined work: if we recommend a repair or treatment (in a quote or report) and you decline or defer it, we are not responsible for damage that the recommended work was intended to prevent.
9. Limitation of liability
To the fullest extent permitted by law: (a) our total liability for any claim relating to membership services is limited to the amounts you paid us in the 3 months preceding the event, and for quoted work to the price of that job; (b) we are not liable for indirect, incidental, special, or consequential damages (including loss of use, landscaping, or water costs); (c) repair parts carry the manufacturer’s warranty only, which we pass through to you; our repair workmanship is warranted for 45 days.
Nothing in this Agreement releases All Set from, or limits liability for, gross negligence, willful misconduct, or anything that cannot be released or limited under Nevada law. Where we negligently damage something we were servicing, we will repair or pay for it within the limits above — this Agreement is about risks we do not control, not an excuse for bad work.
10. Assumption of risk
You acknowledge that pool service involves water, electricity, pressurized plumbing, and chemicals; that outcomes on aged or previously damaged pools cannot be guaranteed; and that you accept the inherent risks described in Section 8 for work you have asked us to perform.
Part D — General
11. Communications
Service updates, reports, receipts, and account messages are sent to the email and phone number you provide. Text us anytime at (725) 280-4335 or email hello@allsetpools.com.
12. Disputes
This Agreement is governed by Nevada law. Any dispute will be brought in the courts of Clark County, Nevada (small-claims where eligible).
13. Miscellaneous
If any provision is unenforceable, the rest remains in effect. This Agreement plus your checkout selections and (for quoted work) your quote constitute the entire agreement. We may update these terms prospectively; the version you accepted at checkout (recorded with a timestamp and IP at assent) governs the services you purchased under it.
14. Price changes
We set and may change the price of our services at our sole discretion and at any time, including for service already being provided. In practice we give at least thirty (30) days’ written notice before an increase takes effect on an existing membership, and it is our intention to continue doing so; nothing in this paragraph obliges us to. The price quoted to you before you subscribe is the price you are charged at signup. If you do not agree to a price change you may cancel at any time under Section 3, and you will not be charged beyond your current billing period.
15. Transfer of your account
We may assign, sell, or transfer your account, this Agreement, and the rights and obligations under it to another pool service provider or to a successor business, in whole or in part, without your prior consent. Your plan, your price, and the services described here carry over to the receiving provider for the remainder of your current billing period. You may cancel at any time under Section 3 if you would rather not continue with them.
